1. General Provisions and Scope

These Terms and Conditions (T&Cs) apply to all contracts concluded between MIHAI CIORBA, e.U. (hereinafter “Seller”) and the consumer via the online shop. The Seller’s details are as listed in the Impressum. A Consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed (as per §1 KSchG).

2. Conclusion of Contract

1. The presentation of goods in the online shop does not constitute a legally binding offer, but a non-binding invitation to the customer to place an order.
2. The customer places a binding offer to purchase by clicking the “Order with obligation to pay” button (§8 FAGG).
3. The Seller shall immediately confirm receipt of the order by an automated email (Confirmation of Receipt). This email does not yet constitute acceptance of the contract.
4. The contract is concluded when the Seller sends a separate Shipping Confirmation or a specific Order Acceptance email.

3. Prices and Payment

1. All prices are stated in Euros (€) and include the statutory Austrian Value Added Tax (VAT) of 20%. Shipping costs are charged separately.
2. Shipping Costs:
   • free delivery in Austria;
   • other EU countries: 14,90€ for orders under 150€, free delivery for orders over 150€.
3. The following payment methods are accepted: Visa/MasterCard, PayPal and KLARNA.
4. The goods remain the property of the Seller until full payment has been received (Retention of Title).

4. Delivery and Shipping

1. Delivery takes place within the EU countries only.
2. The estimated delivery time is 2-4 working days after contract acceptance.
3. The risk of accidental loss or deterioration of the goods passes to the consumer only upon delivery of the item to the consumer (§7a KSchG).

5. Right of Withdrawal (Widerrufsrecht)

Consumers are entitled to the statutory 14-day right of withdrawal from a distance contract. The specific details, including the procedure and the statutory Model Withdrawal Form, are set out in the separate Return and Withdrawal Policy document.

6. Warranty (Gewährleistung) and Liability

All our articles follow strict quality controls so that you receive them and enjoy them in the best conditions.
However, if you have received a faulty item in your order, or if after using it, you detect a defect, please contact us or visit our store so that we can help you.

7. Final Provisions

1. Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). This choice of law applies only to the extent that the consumer is not deprived of mandatory protection afforded by the law of the state of their habitual residence.
2. The place of jurisdiction for consumers is the court in whose district the consumer has their domicile, habitual residence, or place of employment (§14 KSchG).
